General terms of participation in the BreakFlow device

Nature of the device

BreakFlow is a contemporary art installation designed and operated by Hector Basky (hereinafter "the artist"). The device links a digital payment to an irreversible physical action: the mechanical blow of a plaster fragment by an automated striker. The entire process is recorded, archived and restituted in real time.

BreakFlow is not a business. It is neither a sale of goods nor a service in the classic sense of the term. The device belongs to artistic creation and performance.

Purpose of participation

By participating, the user remotely triggers a sequence of material and digital operations. This participation gives rise to:

  • The execution of one or more mechanical blows on a physical fragment
  • The inscription of the chosen pseudonym in the public register of the work
  • The video capture of the destruction in real time
  • The archiving of the associated data (intensity, fragment, timestamp)

The participant receives no material good in return. The debris produced is packaged in labeled pouches that remain at the installation as components of the work. Participation is an inscription in a process, not a commercial transaction.

Participation and payment terms

The amount per blow is fixed and displayed on the site at the moment of participation. Payment is made electronically (Bancontact / bank card via Stripe). No cash payment is accepted.

The number of blows required to destroy a fragment (intensity) is variable and evolves according to the device's internal parameters. This mechanism is an integral part of the work. The participant is informed of the intensity in effect at the moment of their participation.

Irrevocable nature

Any participation is final and irrevocable. In accordance with Article VI.53, 1 of the Belgian Code of Economic Law, the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium whose performance has begun with the consumer's prior consent.

By validating their participation, the user acknowledges and accepts that:

  • The execution of the strike will begin as soon as the queue allows
  • The action is physically irreversible
  • No refund will be granted after payment validation

Deferred execution

Participations are executed in queue order, during live sessions. The delay between payment and execution depends on the number of pending participations and the machine's availability. This operation is inherent to the device and does not constitute a delay in the commercial sense.

Pseudonym and data

The participant chooses a pseudonym that will be publicly inscribed in the register of the work, visible on the site and potentially in the video archives. This pseudonym cannot be modified after validation. The artist reserves the right to filter pseudonyms that are insulting, hateful or contrary to public order.

Payment data is processed by Stripe and is never stored by the device. Only the data necessary for the operation of the work is kept: pseudonym, timestamp, participation reference, associated fragment.

Reinvestment of resources

All resources generated by participations are reinvested in the operation, maintenance and development of the device. This includes in particular:

  • The cost of materials (plaster, moulds, consumables)
  • Hosting, streaming and technical infrastructure costs
  • Payment processing fees
  • The acquisition of equipment for the installation
  • Applicable tax and social charges

The device does not pursue profit. It operates as a self-evolving system whose resources feed its own expansion.

Transparency

All of the device's operating data is publicly accessible on the site:

  • Register: complete history of participations, costs and residuals
  • Loss: real-time economic analysis (revenue, costs, margin)
  • Intensity: real-time destruction parameters
  • Status: technical state of the device
  • Traces: the artist's logbook

This complete transparency is part of the work. It does not aim to prove, but to stabilize.

Liability

The artist undertakes to execute each validated participation under normal operating conditions. In the event of a technical failure preventing execution, pending participations will be executed when the device resumes.

The artist cannot be held liable for interruptions due to external factors (internet outage, power failure, equipment maintenance).

Intellectual property

The entire BreakFlow device (code, design, mechanisms, archives, videos, data) constitutes an artistic work protected by copyright. Any reproduction, redistribution or commercial use of the contents is prohibited without the artist's prior authorization.

By participating, the user authorizes the use of their pseudonym within the framework of the work (register, archives, exhibitions).

Governing law and disputes

These terms are governed by Belgian law. Any dispute will be submitted to the competent courts of Brussels, Belgium.
